Terms of Service
WOMO is operated by DE Management Group s.r.o., Klimentská 2066/19, 110 00 Praha 1, Czech Republic (IČO 07345771, VAT CZ07345771, registered at the Municipal Court in Prague, C 299549) (“WOMO”, “we”). By using WOMO you agree to these terms.
1. What WOMO provides
- WOMO makes short motion films from your brief and from anything you add: logos, images and websites.
- Films are generated with automated and AI-assisted tools. Results vary between generations, and a new version may differ from the last.
- We don’t guarantee that a film will be unique or error-free, that it will suit a particular commercial purpose, or that it won’t resemble third-party material.
2. Payment and delivery
- You watch the generated film before you buy it.
- When you choose Buy & download and your payment is confirmed, the files for that film become available to download.
- 16:9 is available immediately.
- 9:16, 1:1 and 4:5 follow within minutes.
- The price is shown before you pay, currently USD 49 per film. Payment is processed by Stripe.
- Your downloads stay available from your private link for 24 months after purchase. Download your files straight away and keep your own copy.
3. Refunds and withdrawal
- All sales are final once digital delivery begins, except where the law says otherwise.
- Before you pay, we ask you to tick a box (never pre-ticked) confirming that you consent to immediate supply of the digital content, and that you lose your statutory right of withdrawal once delivery or download begins. We store that consent with your order, and the invoice Stripe emails you confirms it.
- This doesn’t affect your legal rights if a file is faulty or doesn’t match what you were shown. In that case write to hello@getwomo.com, and we’ll fix it, replace it or refund you as the law requires.
4. Your content
- You must own, or have all the rights you need for, everything you submit: logos, photographs, videos, trademarks, music, copy, website material and any other content.
- You confirm that your material and your instructions don’t infringe anyone’s copyright, trademark, privacy, publicity or other rights.
- WOMO does no legal, trademark or copyright clearance for you. You decide whether a finished film can lawfully be published or used commercially.
5. Your rights in the film you buy
- Once you’ve paid, you may use, copy, edit, publish and distribute the film you bought, worldwide and without time limit, for any lawful personal or commercial purpose. That includes your website, ads and social media.
- You may not resell or license the film itself to others as stock footage or as a template.
- WOMO keeps all rights in its software, engines, templates, visual worlds, systems, tooling, music beds and generic design components. None of that is transferred to you, and similar elements may appear in other customers’ films.
- Until you pay, a preview may only be watched and shared as a preview, with its preview mark.
6. AI and third-party risk
- Generated material may, without anyone intending it, resemble existing works, brands, people or styles.
- We don’t promise exclusivity, and we don’t promise that a film infringes no one’s rights.
- Review every film before you publish it or use it commercially.
7. Prohibited use
- Don’t use WOMO for anything unlawful, infringing, fraudulent, abusive or malicious, and don’t submit content you aren’t entitled to use.
- We may refuse a brief, stop a generation, suspend access or remove content where that’s reasonably necessary.
8. Availability
- WOMO is provided “as available”.
- Generation times are estimates, not promises.
- Renders can fail, and the service or the services we rely on can be interrupted. Where it makes sense, WOMO retries a generation or lets you try again.
9. Disclaimer
To the maximum extent permitted by law:
- WOMO is provided without warranties, except those the law doesn’t allow us to exclude.
- We aren’t responsible for your business decisions, your advertising claims, your regulatory compliance, or how you publish or use a film.
- We don’t guarantee commercial results, sales, engagement or performance.
10. Limitation of liability
To the maximum extent permitted by law:
- We’re not liable for indirect, incidental, consequential or special damages, or for lost profits.
- Our total liability for an order is limited to the amount you paid for it.
- Nothing here limits liability that can’t be limited by law, such as liability for intent or gross negligence, or your mandatory rights as a consumer.
11. Your responsibility
If you use WOMO for your business, you agree to cover the losses and reasonable costs we face from third-party claims caused by any of the following:
- content you submitted without the necessary rights;
- unlawful instructions;
- your publication or use of a film in breach of the law or someone else’s rights.
If you’re a consumer, this applies only as far as the law allows.
12. Changes, ending and law
- We may update these terms. The version in force when you buy applies to that purchase.
- We may end your access if you seriously or repeatedly break these terms.
- These terms are governed by the laws of the Czech Republic. The courts of Prague, Czech Republic, have jurisdiction. This doesn’t remove the protection consumers have under the mandatory law of the country where they live.
- EU consumers may also use their national consumer authority. In the Czech Republic that’s the Czech Trade Inspection Authority (coi.cz).
